These Terms of Service ("Terms") govern your use of the Mixology Ice website and your purchase of pre-ordered products from 2dor Gourmet Ice LLC, doing business as Mixology Ice ("Mixology Ice", "we", "us", or "our"). By accessing this site or placing a pre-order, you agree to be bound by these Terms and our Privacy Policy.
The site offers the Marca ice-branding machine and related accessories (brass plates, letter board cases) for pre-order ahead of the 2027 midyear manufacturing launch. All pre-orders are subject to our Pre-Order Policy, which is incorporated into these Terms.
Placing a pre-order constitutes an offer to purchase. An order is confirmed when payment is successfully processed. Prices are shown in U.S. dollars and do not include applicable taxes, duties, or shipping charges, which may be added at checkout or on delivery. We reserve the right to refuse or cancel any order, subject to the Pre-Order Policy.
The Marca machine, the site, its content, branding, and all related designs are protected by U.S. Patent No. 12,263,697 and other intellectual property rights owned by 2dor Gourmet Ice LLC. You may not copy, reproduce, or exploit any of it without our prior written consent. You retain ownership of artwork you submit for custom plates and grant us a limited license to produce your plate and display your design in connection with fulfilling your order.
The Marca machine uses a heated brass plate and must be used in accordance with the instructions provided. You agree to use the product as intended, keep it away from children, and assume responsibility for any use inconsistent with the instructions. Product images and renders are illustrative; minor production variations may occur.
The site and products are provided "as is" and "as available" without warranties of any kind, express or implied, except for the limited warranty provided with the product, if any. We disclaim all other warranties, including warranties of merchantability or fitness for a particular purpose, to the maximum extent permitted by law.
To the maximum extent permitted by law, Mixology Ice shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from or related to your use of the site or the products. Our total liability for any claim shall not exceed the amount you paid for the product giving rise to the claim.
You agree to indemnify and hold harmless 2dor Gourmet Ice LLC and its members, employees, and agents from any claims, damages, or expenses arising from your violation of these Terms or your misuse of the products.
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute shall be resolved in the state or federal courts located in Miami-Dade County, Florida.
We may update these Terms from time to time. The "Last updated" date above reflects the current version, which applies to all orders placed after that date.
